Currently there is a total of 83 teams participating:

The 20 clubs from Primera División (1st div.) 2008/09 season.
21 clubs from Segunda División (2nd div.) 2008/09 season, with the exception of Sevilla Atlético, which is a reserve team.
24 from Segunda B (2nd B): the top 5 clubs qualified from every group (20) and the next four with the must number of points.
The 18 from the Tercera División corresponding the top of each group.

Competition Format

The tournament is divided in 7 stages and a final match; the teams are match up with a random system. The final as well as the first 3 qualifying rounds are played by one-off games, while the round of 32, round of 16, quarterfinals and semifinals are played by two legs.

The 83 teams from the 2007/08 season will be distributed like this:

Group A: will contain the 18 teams chose from the Tercera División.
Group B: has all the teams from Segunda B (24), but in order to have 18 clubs to play against the Group A, 6 teams are chosen to be exempted from the first round.
Group C: holds the 21 clubs from Segunda División.
Group D: the 10 teams from Primera Division 2007/08 season that didn't qualify to the UEFA Champions League or the UEFA Cup plus the three teams ascended from Second Division after the 2007/08 season.
Group E: is composed by the 7 clubs from Primera Division 2007/08 that qualified to the two the UEFA's Champions League and Cup.

Structure of La Copa del Rey 2008/09:

First Qualifying Round (27.August.2008): Group A will play against the 18 teams selected from Group B.
Second Qualifying Round (3.September.2008): is subdivided in two groups. In the first are the remaining 6 teams selected from Group B, joining the 18 winners from first round, this 24 teams will to play between them. On the second group are the 20 clubs from Group C, which will play each other (chosen by draw one team from the Group C is exempt).
Third Qualifying Round (8.October.2008): as well as in the past round, this one is subdivided in two: a) the 12 winners from the first group and b) the 10 winners from the second group from the 2nd round. But one of this teams is exempted, and instead of it plays the one that didn't participate on second the round.
Round of 32 (29.October.08 & 12. November.08): on this stage the 20 teams from Primera Division will join the Cup. The 11 winners from 3rd qualifying round (6 from a) and 5 from b)), plus the one that got exempted from it. All clubs are subdivided in two main groups.
Round of 16 (7.November.08 & 14.November.08): play the 16 winner teams from the round of 32: 6 from the one subdivision and 10 from the other.
Quarterfinals (21.January.2009 & 28.January.2009): the 8 winners from the 16's round.
Semifinals (4.February.09 & 4.March.09): the remaining 4 winners from quarterfinals.
Final (13.May.2009): it is played between the last 2 clubs winners in semifinals.
